How VelarixMarketing Uses Personal Information It Collects About You and the Purposes for the Collection and Use We use the Personal Information we collect from you, or that you provide to us, for the following purposes: 1.     For Platform Functionality and Development: We utilize the information to deliver, improve, and customize the Platform and other services we offer. Certain data, such as your IP address, enables us to connect with your device, measure Platform usage, diagnose server issues, and enhance security features. We also use the information for various business purposes, including data analysis related to testing, modifying, enhancing, or creating new products, services, and technologies, and identifying emerging trends. Some features of the Platform may utilize artificial intelligence ("AI") tools to improve performance. However, we do NOT use Personal Information to train or enhance generalized AI or machine learning models, including user data obtained via third-party APIs, such as Google Workspace APIs. If your information is transferred to any app using Google APIs, it will comply with the Google API Services User Data Policy, including the Limited Use requirements. 2.     For Customer Support, Platform Updates, and Reporting: The Platform may utilize your information to provide updates, check for system performance, and ensure the Platform operates efficiently. Update functionalities may automatically scan your system to determine whether updates or security patches are necessary, ensuring you always have access to the latest features, security enhancements, and options. Your information also helps us analyze the Platform’s performance and make improvements. We use Personal Information to provide you with customer support for the Platform and services, and to confirm eligibility for promotional offers.

For example, if you connect your YouTube account, Google’s Privacy Policy applies. You can revoke access at any time through your Google security settings.


●      In the Event of Sales, Mergers, or Acquisitions: We may share your Personal Information as part of a corporate transaction, such as a merger, acquisition, reorganization, or sale of assets.


●      With Your Consent: If you consent, we may disclose your Personal Information to any third party you authorize. For example, you can opt in to share data for advertising purposes as described in the section "Your Choices & Rights" below.


We do not share your phone number or opt-in consent with third parties unless we have received your explicit written consent to do so. Additionally, we may share non-personally identifiable information, such as anonymized or aggregated data, with suppliers and research partners for purposes like trend analysis, product development, and improving our services.   6. Information from Children We do not knowingly collect, use, or disclose any Personal Information from children under the age of 16. If we become aware that we have inadvertently collected Personal Information from a child under 16 (or the equivalent minimum age in the jurisdiction, such as 13 in the United States per the Children’s Online Privacy Protection Act), we will take immediate steps to delete that information. If you are under the age of 16, please do not provide any Personal Information about yourself to HighLevel, including your name, address, telephone number, or email address. 7. Links to Other Websites and Services The Platform may contain links to other websites or services. Please be aware that we are not responsible for the practices of third-party websites or services linked to or from the Platform, including the information or content found on those sites. This Privacy Policy does not apply to, and we are not responsible for, the privacy policies, data collection practices, or security measures of third parties. This includes: ●      (a) Any third-party website or service linked to from the Platform – the inclusion of such a link does not imply endorsement by us or our affiliates.


●      (b) Any app developer, social media platform provider, operating system provider, wireless service provider, or device manufacturer (such as Facebook, Apple, Google, Microsoft, LinkedIn, etc.) – including any Personal Information you disclose to these organizations through the Platform or other HighLevel Services.


We encourage you to review the privacy policies of any third-party services before sharing your information.


8. Do Not Track Certain browsers offer a “Do Not Track” (“DNT”) feature, which signals to websites and online services that you do not wish to be tracked. Currently, the Platform does not respond to DNT signals.


9. YOUR LEGAL RIGHTS HighLevel respects your rights regarding your Personal Information. Depending on your location, you may have specific rights, including the ability to request access to or correction of your Personal Information. You may also have the right to opt out of receiving marketing materials from us or to limit the ways in which we use your data for marketing purposes. European Privacy Rights If you are in Europe, you may have additional rights under the General Data Protection Regulation (GDPR), the UK GDPR, or the Swiss Federal Act on Data Protection (FADP). Additional choices and rights may be available to you depending on which HighLevel services you use. ●      Access, Correction, or Deletion of Your Information:


If you wish to correct or update your Personal Information, or request access to or deletion of your Personal Information, you can contact us via the Platform or using the contact details in the "HOW TO CONTACT US" section below. Please note that if you request changes or deletion of your Personal Information, we may still need to retain certain data for record-keeping purposes, to complete transactions, or to fulfill legal obligations. For example, if you make a purchase or participate in a promotion, you may not be able to delete or change your information until after the completion of that transaction. Some information may also remain in our systems and other records for compliance with applicable laws.

  11. International Compliance Velarix Marketing operates globally, with its headquarters in the United States. As such, we may transfer your Personal Information to our affiliates and business partners in other countries, including third-party service providers who may be located in jurisdictions other than your own. We transfer Personal Information internationally to ensure operational efficiency, enhance performance, and establish redundancy in the event of service interruptions. When transferring Personal Information across borders, we ensure compliance with this Privacy Policy and applicable laws. For Personal Information originating from the European Economic Area (EEA), the United Kingdom (UK), or Switzerland, Velarix Marketing participates in the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK extension to the EU-U.S. DPF, and/or the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF). Velarix Marketing adheres to the DPF Principles and will take additional steps, as necessary, to ensure your Personal Information is adequately protected during these transfers. Velarix Marketing may be required to disclose Personal Information in response to lawful requests by public authorities, including those related to national security or law enforcement. Velarix Marketing is also responsible for onward transfers of Personal Information to third parties. 12. Data Privacy Framework Velarix Marketing, Inc. and LeadConnector LLC comply with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as outlined by the U.S. Department of Commerce. Velarix Marketing has certified to the U.S. Department of Commerce that both Velarix Marketing and LeadConnector adhere to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) regarding the processing of personal data received from the European Union under the EU-U.S. DPF and from the United Kingdom (including Gibraltar) under the UK Extension to the EU-U.S. DPF. Additionally, Velarix Marketing has certified compliance with the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) for processing personal data received from Switzerland in reliance on the Swiss-U.S. DPF. In the event of a conflict between the terms of this privacy policy and the EU-U.S. DPF Principles or Swiss-U.S. DPF Principles, the Principles will prevail. For further details about the Data Privacy Framework (DPF) program and to view our certification, please visit https://www.dataprivacyframework.gov/. Velarix Marketing further agrees to promptly notify you if its certification under any of the Data Privacy Frameworks is revoked, terminated, or invalidated, and to take the necessary actions to stop or correct any unauthorized processing of personal data.

California Privacy Rights This section applies to residents of California and provides additional information about your rights under the California Consumer Privacy Act or "CCPA" (California Civil Code Section 1798.100 et seq.), as amended. When you submit a CCPA request, Velarix Marketing may require additional information to verify your identity, depending on your previous interactions with Velarix Marketing and the sensitivity of the data. If we deny your request, we will explain the reasons for the denial. You may designate an authorized agent to submit a CCPA request on your behalf in certain cases. If you appoint an agent, Velarix Marketing may ask you to confirm your identity or provide authorization that allows the agent to act on your behalf. In cases where you grant an authorized agent power of attorney under the applicable law, Velarix Marketing will respond accordingly without further verification. This will depend on your previous interactions with Velarix Marketing and the sensitivity of the Personal Information in question. If your request is denied, we will explain the reason for the denial. If Velarix Marketing has not responded to your request or requires additional time to respond (up to 45 days after you submit the request), you have the right to appeal the failure to act. To appeal, contact us using the details provided in the “HOW TO CONTACT US” section. You may designate an authorized agent to make a request under the CPA on your behalf in certain circumstances. If you use an authorized agent, Velarix Marketing may ask you to verify your identity or confirm that the authorized agent has signed permission to submit a request under the CPA.

If you submit a request to exercise your rights under the VCDPA, Velarix Marketing will ask you to provide certain information to verify your identity. This will depend on your previous interactions with Velarix Marketing and the sensitivity of the Personal Information involved.
